1. Why should I choose mediation over litigation? There are many reasons to consider mediation before you go through the court system to settle your divorce. First, the court system actually recommends that all couples try mediation first because the court system’s calendar is so backed up that it cannot accommodate all of the divorce cases. In addition, divorce mediation is less expensive and takes less time than litigation and can lay a more positive foundation for future communication with your ex about things like co-parenting.
2. How much does mediation cost? If you choose to work with AMS Mediation, you can expect to pay around $4000 (combined). This includes your mediator fees, filing fees (to your county) as well as fees for drafting.
3. What is the role of a divorce mediator? Unlike a judge, a divorce mediator is not a decider in a divorce case. Instead, a mediator will facilitate a discussion during the divorce settlement process, encouraging both parties to find a resolution. A mediator is a neutral third party who is trained to help lead a productive and positive discussion that will yield a settlement based on compromise.
4. How long will divorce mediation take? Every divorce mediation case is different, of course, but you can expect to take several 2-3 mediation sessions over the course of 6-8 weeks. You can complete this process in person or virtually, depending on your preference. Keep in mind that processing the documents can take another 1-8 weeks after the mediation process is complete.
5. What can I do to prepare for the divorce mediation process? To make the process as smooth as possible, we recommend that you gather financial documents ahead of the first mediation session, think about any priorities that you have and come into the session with an open mind and a willingness to compromise.

Limited In-Person Services

We have resumed limited in-person services for sessions with 1 or 2 participants scheduled for a maximum of 2 hours. Masks are required in our building and in session. Availability is subject to change based on local regulations and CDC guidelines.
